Question: I want to get to the bottom of this issue ( Breast Implants)
once and for all...
Can you or can you not deduct the cost of breast implants?
If so, over how long must they be written off?
Can Sec 179 be claimed?
Answer: Generally, you cannot include in medical expenses the amount you pay for
unnecessary cosmetic surgery. This applies to any procedure that is
directed at improving the patient's appearance and does not meaningfully
promote the proper function of the body or prevent or treat illness or
disease. Procedures such as face lifts, hair transplants, hair removal (electrolysis), and liposuction generally are not deductible.
You can include in medical expenses the amount you pay for cosmetic
surgery if it is necessary to improve a deformity arising from, or
directly reelated to, a congenital abnormality, a personal injury
resulting from an accident or trauma, or disfiguring disease.
Ergo, if you had implants to improve your appearance, it is unlikely you
could claim a deduction. If you had them for the other reasons specified,
you could deduct the expense.
As a medical expense, your deduction is subject to a 7.5% reduction based
on your adjusted gross income for year in which you pay the bill.
A section 179 deduction would not be allowed for non-business assets. I
suppose, if you needed the transplant for your job, and it was suitable
for no other use, you could make a case. But for the life of me, I just
don't know how you would depreciate those things. If you think you have a
case, you might be able to take
them off as a business expense instead of a medical expense. However, I'd
want
to get an IRS ruling before taking that kind of a deduction.
